Please read these terms and conditions carefully before using Myboss services.
The following are terms of a legal agreement between you and Myboss. By accessing, browsing, or by beginning to use the Myboss Application, you acknowledge that you have read, understood, and agree to be bound by these terms and to comply with all applicable laws and regulations.
If you wish to use the Myboss Application, you must create a unique user account on the sign-up page on our website, which you can find from a link on our home page at www.myboss.com.au. If you create an account on behalf of a company or entity, you represent that you are authorized to act on behalf of that company or entity.
Myboss reserves the right to modify them at any time, and without actual notice to you.
If you do not agree to these terms, please do not use this Website.

If you register for an account, you agree to provide accurate, current and complete information, maintain the security of your password and promptly update the Registration Data, and any other information you provide to Myboss. Your username and password must be approved by Myboss and we may refuse to approve a username or password at our sole discretion. You accept all risks of unauthorized access to the Registration Data and any other information you provide to Myboss. You are responsible for all activity on your Myboss account, and for all charges incurred by your Myboss account. All Authorized Users must be 18 years old or older, and are legal residents of Australia.

Fees and any other charges for the use of our service are described on the site or you can contact us on 9999 1188 for more details. They may change from time to time. We will give you at least 30 days’ notice, if any changes are made. If there are any changes and your continued use our service after the changes, indicates your agreement with the new fees and charges after the effective date of any changes. Any changes to fees and other charges will not be applicable to the billing period in when the changes occurs. An “Initial Set up Fee” of $259 and an ongoing monthly subscription service fee (per user) applies to all new users. Myboss may cancel or suspend your service if you violate the terms of your contract. If we do, your right to use the service will cease immediately. Cancellation. You may cancel your service with Myboss anytime for any reason. You must notify Myboss 30 days in advance prior to the next billing period or you will be charge in full for that period. You may cancel your subscription at any time within the first 30 days of signing up. However, the $259 flat “Initial Setup Fee” will not be refunded to you. If you do not notify Myboss of your decision to cancel or upgrade, your account will automatically renew itself at the end of your contract period.

We take reliability and security seriously by putting a great deal of effort into ensuring that our service operates all the time, and that it is a secure environment for your data
In addition, Myboss application is hosted in a secure server environment that uses a firewall and other advanced technology to prevent interference or access from outside intruders.
However Myboss Application may not be available when we may make periodic upgrades or perform scheduled maintenance. We will use reasonable efforts to alert Authorized Users to scheduled upgrade or maintenance interruptions, but we make no warranties or guarantees of continuous or uninterrupted service. When you use Myboss, you accept these risks, and the responsibility for choosing to use a technology that does not provide perfect security or reliability.
We have no obligation to monitor or police communications or data transmitted through the Myboss Application and we will not be responsible for the content of any such communications or transmissions. You are responsible for the content of any communications and data that you transmit, upload or post through the Myboss Application.
You will not attempt to gain access to any portion of our systems or networks in any way that is not necessary for you to use the Myboss Application. You agree to keep confidential and not disclose to any third parties any usernames, passwords and account numbers associated with the Myboss Application.
You may not provide any of Myboss competitors with access of any kind to the Myboss Application.

"Myboss Trademarks" means all names, marks, brands, logos, designs, trade dress, slogans and other designations Myboss uses in connection with its products and services. You agree to comply with the Sun Trademark and Logo Usage Requirements and you may not remove or alter any Myboss Trademarks, without Sun's prior written consent.
Except as expressly authorized by Myboss, You agree not to reproduce, modify, rent, lease, license, loan, sell, distribute, mirror, download, host, transmit, or create derivative works of the Content of others, in whole or in part, by any means. You must not modify, decompile, or reverse engineer any software Myboss discloses to you, and you must not remove or modify any copyright or trademark notice, or other notice of ownership
User Content; When you use the Myboss Application, you will be providing us with information, accounts, data, and other information and materials pertaining to your business (referred to here as your “User Data”). We acknowledge that your User Data belongs to you. When you submit any User Data to Myboss, you represent that you have all necessary rights in and to that User Data and you hereby grant us a license to use your User Data, solely for the purpose of making the Myboss Application available to you and your Authorized Users
Your User Content is your responsibility. We have no responsibility or liability for it, or for any loss or damage your User Content may cause to other people. Although we have no obligation to do so, we have the absolute discretion to remove, screen or edit without notice any User Content posted or stored on the Site, and we may do this at any time and for any reason. You are solely responsible for maintaining copies of and replacing any User Content you post or store on the Site
We do not claim any ownership interest in your User Content, but we do need the right to use your User Content to the extent necessary to operate the Site, and provide the services provided by the Site, now and in the future. Therefore, by posting or distributing User Content to or through the Site, you (a) grant Myboss and its affiliates and subsidiaries a non-exclusive, royalty-free, transferable right to use, display, perform, reproduce, distribute, publish, modify, adapt, translate, and create derivative works from such User Content on the Site, in the manner in and for the purposes for which the Site from time to time uses such User Content

The use of this website is at your sole risk. All materials, information, products, contents are provided “As is” with no warranties or guarantees whatsoever.
Myboss disclaims all express or implied conditions, representations, and warranties of any kind, including without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary and intellectual property rights.
Myboss makes no warranty or guarantee that this web site will be uninterrupted, timely, accurate, secure, or error-free.
You understand and agree that if you download or otherwise obtain materials, information, products, software, programs, or services, you do so at your own discretion and risk and that you will be solely responsible for any damages that may result, including loss of data.

Myboss and its suppliers are not engaged in rendering legal, accounting or other professional services. You should seek the services of a competent professional, if you required legal expert assistance or accounting advice. We expressly disclaim any representations or warranties that your use of the Myboss application will satisfy any statutory or regulatory obligations or will otherwise ensure compliance with any applicable local, state, federal, national or international laws or regulations. You are solely responsible for ensuring that your use of the Myboss application is in accordance with the applicable laws.

In no event will Myboss be liable to any party for any direct, indirect, incidental, special, exemplary or consequential damages of any type whatsoever related to or arising from this web site or any use of Myboss application, or of any site or resource linked to, referenced, or accessed through this web sit, or for the use or downloading of, or access to, any materials, information, products, or services, including, without limitation, any lost profits, business interruption, lost savings or loss of programs or other data, even if Myboss is expressly advised of the possibility of such damages. This exclusion and waiver of liability applies to all causes of action, whether based on contract, warranty, tort, or any other legal theories.

We may modify these Terms of Use from time to time. We will notify you of all changes to these Terms of Use through a notice posted to the Myboss.com.au website. We will also post on these Terms of Use the date on which they were last modified. You will be deemed to have agreed to the Terms of Use as last modified and to be bound by them when you use the Myboss Application after those modifications were posted.
